These Terms of Service ("Terms") govern your use of dublinsilverband.com and the related services (collectively, the "Site") provided by the Dublin Silver Band("DSB", "we", "us"), a brass band operating under Dublin Community Bands, a 501(c)(3) nonprofit organization based in Dublin, Ohio. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 13 years old to use the Site. If you are between 13 and 18, you may use the Site only with the involvement of a parent or guardian. The Dublin Silver Band's youth program handles minors' participation through separate paper or in-person forms.
2. Accounts
Some areas of the Site — the donor portal, the members-only area, and certain administrative tools — require an account. Accounts are created and authenticated through Clerk. You are responsible for the activity that occurs under your account and for keeping your sign-in credentials secure. Notify us at dublinsilverband1@gmail.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms.
3. Donations
Donations submitted through the Site are processed by Givebutter and benefit Dublin Community Bands, our 501(c)(3) parent organization. Donations are generally non-refundable, except where required by law or in the case of a documented processing error. Tax receipts are issued by Givebutter and are emailed to the address you provide at checkout. The deductibility of any donation is determined by U.S. tax law and your individual circumstances; consult a tax professional for advice on your specific situation.
4. Hire inquiries and bookings
Submitting a hire-inquiry form is a request for information, not a contract. A booking is only confirmed once we have signed a written engagement agreement and any required deposit has been received. Quoted fees are estimates valid for 30 days unless we tell you otherwise in writing.
5. Acceptable use
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms.
- Attempt to gain unauthorized access to any account, server, or part of the Site.
- Interfere with the operation of the Site, including by submitting malware, scraping at scale, or sending automated requests intended to disrupt service.
- Misrepresent your identity, the source of a donation, or your authority to act on behalf of an organization.
- Submit content that is unlawful, defamatory, harassing, or infringes on the rights of others.
6. Intellectual property
The DSB name, logos, photographs, recordings, performance video, and original written content on the Site are the property of the Dublin Silver Band or our parent organization, or are used with permission. You may share links to public pages and quote short excerpts with attribution, but you may not reproduce, distribute, or create derivative works from our content without our written permission.
Sheet music in our library is licensed to us by the original publisher. The Site's content management system is for internal administrative use; nothing on it grants you a license to use copyrighted music outside our performances.
7. User-submitted content
If you submit content to us through the Site (for example, in a hire inquiry, a sponsor reply, or a member profile), you grant us a non-exclusive, royalty-free license to use that content for the purpose for which you submitted it — corresponding with you about an engagement, displaying your member profile to other members, etc. You retain ownership of your content. You represent that you have the right to submit the content and that doing so does not infringe on anyone else's rights.
8. Third-party services
The Site relies on third-party services including Givebutter, Stripe, Clerk, SendGrid, Meta (Facebook Graph API), and Google. Their handling of your information is governed by their own terms and privacy policies. We are not responsible for the operation or policies of these services beyond our own integration with them.
9. Disclaimers
The Site is provided on an "as-is" and "as-available" basis. We do our best to keep it running, accurate, and secure, but we make no warranties — express or implied — about availability, accuracy, fitness for a particular purpose, non-infringement, or that the Site will be free of errors or harmful components. Concert and rehearsal information published on the Site may change; check with us before relying on it for travel plans.
10. Limitation of liability
To the fullest extent permitted by law, DSB and Dublin Community Bands, and our respective officers, members, volunteers, and contractors, will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site, including lost profits, lost data, or business interruption, even if we have been advised of the possibility of such damages. Our total liability arising out of or in connection with these Terms or the Site will not exceed one hundred dollars (USD $100) or the amount you paid us in the twelve months preceding the event giving rise to the claim, whichever is greater.
11. Indemnification
You agree to indemnify and hold harmless DSB, Dublin Community Bands, and our respective officers, members, volunteers, and contractors from any claim, demand, or expense (including reasonable attorneys' fees) arising out of your use of the Site, your breach of these Terms, or your violation of any law or third-party right.
12. Governing law and disputes
These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Franklin County, Ohio, and you consent to the personal jurisdiction of those courts.
13. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Material changes will be highlighted on the Site. Your continued use of the Site after the changes take effect constitutes your acceptance of the updated Terms.
